At Alchemy Cloud, Inc. (“Alchemy”, “we” or “us”) we place the highest importance on respecting and protecting the privacy of our customers. Our most important asset is our relationship with you. We want you to feel comfortable and confident when using our website at https://alchemy.cloud (the “Site”). Therefore, we would like to share with you the following principles that govern our information practices and other privacy aspects of our Web site. Throughout this policy, we refer to information that personally identifies you as "Personal Information." By submitting Personal Information to us, you are expressly and voluntarily accepting the terms and conditions of this privacy policy. You have the right to withdraw your consent to our collection and use of your Personal Information by notifying us at legal@alchemy.cloud.
We will update this privacy policy when necessary to reflect customer feedback and changes in our services as well as applicable laws, rules and regulations. When we post changes to this policy, we will revise the "last updated" date at the top of the policy and post the updated policy at https://alchemy.cloud/privacy. If there are material changes to the statement or in how Alchemy will use your personal data, we will notify you either by prominently posting a notice of such changes before they take effect or by directly sending you a notification. We encourage you to periodically review this privacy policy to learn how Alchemy is using and protecting your information. Using the Alchemy Site or services after a notice of changes has been sent to you or published on our Site shall constitute consent to the changed terms and practices. Unless stated otherwise, our current privacy policy applies to all information that Alchemy has about you and your account.

By using our Site or our services, you voluntarily and willingly provide us with certain information, including Personal Information, which we collect in order to provide the Alchemy Site and our service to you. Personal Information refers to information about you that can be used to contact or identify you, and information on your use of and activities at our Site and through our web based services that may be connected with you. When we ask you for information, we will tell you, or it will be clear, what we need to know to fulfill your request. We will also tell you how we will use the information we’re asking for. Our Site is not designed to appeal to children under the age of 13. We do not knowingly request or receive any information from children.
Personal information that we collect may include, but is not limited to, your name, phone number, email address and physical address. Personal Information may also include information you supply to us concerning your preferences and interests expressed in the course of use of our Site and the Alchemy services. If you are unsure whether you would like to provide information to us and/or having your information used as permitted in this Privacy Policy, you should not register on our Site or you should cease using our services.
California Do Not Track Notice. Although Alchemy does not track its customers over time and across third party websites to provide targeted advertising and therefore does not respond to Do Not Track (DNT) signals, some third party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. If you are visiting such sites, your web browser allows you to set the DNT signal on your browser so that third parties (particularly advertisers) know you do not want to be tracked.
We may use the information you provide to (i) provide our Site and services to you and administer your use of our Site and services, (ii) to communicate with you and fulfill requests you may make, (iii) to provide you with information and announcements with respect to our services, and (iv) to provide you with further information and offers from us.
We may use your Personal Information to communicate with you through email and text messages and notices posted at our website or on your account and to provide you with customer support. If you decide at any time that you no longer wish to receive any such communications, please follow the “unsubscribe” instructions provided in any of the communications sent to you.
We may also use the information provided by you or obtained through your use of our Site or services to improve our Site, services, features and content, to customize your user experience, and to better understand your needs and interests. We use information we obtain by technical means (such as the automatic recording performed by our servers or through the use of cookies) for the above purposes as well as to monitor, measure and analyze use of the Site and our services, to generate and derive useful data and information concerning the interests, characteristics and Site use behavior of our users, and to verify that visitors to the Site meet the criteria required to process their requests.
We may use sources outside of Alchemy to supplement the information you give us. For example, we may validate your address using other sources. We use this data to help us maintain accuracy and provide you with better service.
We may use your contact information to tell you about products we think might interest you. However, if you don't want us to contact you for promotional purposes, you can tell us when you provide the information; however, your contact preferences only apply to marketing contacts. We will still use your contact information to communicate with you regarding the usability of and/or critical messages relating to the Site and our services (such as service messages, subscription renewal notices, critical notices, or legally mandated notices) unless you elect to close your account.
We do not sell or rent your personal information to anyone. We do not share your personal information with anyone outside of Alchemy for their promotional, including marketing, use.
Third Party Service Providers. We have limited relationships with third parties to assist us in servicing you, for example, by hosting our services. These service providers are contractually required to maintain the confidentiality of the information we provide them. The contracts outline the appropriate use and handling of your information and prohibit third parties from using any of your personal information for purposes unrelated to the product or service for which they’ve been contracted. Vendors are required to maintain the confidentiality of the information we provide to them.
Legal Disclosures. We may disclose or report personal information in limited circumstances where we believe in good faith that disclosure is required to comply with applicable laws, rules or regulations, to enforce or apply our Terms of Use at https://alchemy.cloud/termsofuse, Master Subscription and Services agreements, and other agreements, or to protect the rights, property, or safety of Alchemy, users of our Site or services, or others. For example, we may be required to disclose Personal Information to cooperate with regulators or law enforcement authorities, to comply with a legal process such as a court order, subpoena, search warrant, or a law enforcement request.
Business Partners. We may have business partners that provide services, some of which may be co-branded. Partner services and sites are clearly identified. When you request any of these products or services, you are permitting us to provide your personal information to the partner to fulfill your request. Our Site may provide links to third-party sites, such as those of our business partners. Because Alchemy does not control the information policies or practices of these third parties, you should review their privacy policies to learn more about how they collect and use personal information.
Business Transfers. Should we sell, merge or transfer any part of our business, part of the sale may include your Personal Information and you agree that any such third party will have the right to continue to use your Personal Information and other information that you provide to us or which we obtain through your use of our Site and/or services.
With Your Consent. Other than as set out above, you will receive notice when information about you might go to third parties, and you will have an opportunity to choose not to share the information.
Privacy Shield. Alchemy’s accountability for personal data that it receives under the Privacy Shield and subsequently transfers to a third party is described in the Privacy Shield Principles. In particular, Alchemy remains responsible and liable under the Privacy Shield Principles if third-party agents that it engages to process the personal data on its behalf do so in a manner inconsistent with the Principles, unless Alchemy proves that it is not responsible for the event giving rise to the damage.
We use a variety of technologies on our Site. Among these are cookies, which are pieces of information that our Site provides to your browser. Cookies allow us to track overall site usage and determine areas users prefer. Cookies also allow us to customize your visit to our Site by recognizing you when you return. You can choose to decline cookies while at our Site, however, this may limit your ability to access certain areas of the Site. Most browsers accept and maintain cookies by default. Check the "Help" menu of your browser to learn how to change your cookie preference.
When we track activity on our Site, we collect information such as your internet service provider, IP address, browser type and version, and pages you view and, if you are using a mobile device, your mobile carrier. We also keep track of how you got to our Site and any links you click on to leave our Site. Once you leave our Site, we do not track you. We use your Web site activity to assist us in offering you a personalized Site experience, assist you with technical support and to tailor our offerings to you.
We may access and set cookies using Web beacons, also known as single-pixel GIFs which are invisible graphical images. These Web beacons tell us useful information regarding our Site such as which pages users access. When we send you e-mails, we may include a single-pixel GIF to determine the number of people who open our e-mails. When you click on a link in an e-mail, we record this individual response to allow us to customize our offerings to you.
To provide you with a seamless experience, we may occasionally use framing. Though your browser may indicate you are at Alchemy’s Site you may be on a partner's site. To determine which site you are on, right-click on the page and then select "properties.” Mac users should press the control key, and click their mouse on the site and then look at "View Source." We protect the confidentiality and security of your Personal Information by using industry-recognized security safeguards such as firewalls, coupled with carefully developed security procedures designed to protect your Personal Information from loss, misuse or unauthorized alteration. Our employees are trained and required to safeguard your Personal Information and, using physical, electronic and procedural safeguards, we restrict access to Personal Information to those employees and agents for business purposes only. Additionally, we use internal and external resources to review the adequacy of our security procedures.
Although Alchemy uses industry standard security measures, the Internet is not a 100% secure environment and Alchemy cannot, and does not, ensure or warrant the security of any information you transmit or store using the Alchemy service. There is no guarantee that your information may not be accessed, disclosed, altered or destroyed by breach of any of Alchemy physical, technical or managerial safeguards and we are not responsible for third party circumvention of your privacy settings or Alchemy’s security measures. You are responsible for maintaining the secrecy of your unique user name, password and account information and for controlling access to your Alchemy account.
In the event that Personal Information is compromised as a result of a breach of security, Alchemy will promptly notify those persons whose Personal Information has been compromised, in accordance with the notification procedures set forth in this Privacy Policy, by email, or as otherwise required by applicable law.
Alchemy’s Site and services are hosted in datacenters in the United States and complies with the U.S.-EU Privacy Shield Framework and Privacy Principles and the U.S.-Swiss Privacy Shield Framework and Privacy Principles as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland. If you have a complaint you may bring your complaint directly to Alchemy at legal@alchemy.cloud and Alchemy will respond to you promptly but in any event within such time period as may be required under the Privacy Shield program. Alchemy has further committed to refer unresolved privacy complaints under the EU-US Privacy Shield Principles BBB EU PRIVACY SHIELD, a non-profit alternative dispute resolution provider located in the United States and operated by the Council of Better Business Bureaus. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit www.bbb.org/EU-privacy-shield/for-eu-consumers/ for more information and to file a complaint. Please note that if your complaint is not resolved through these channels, under limited circumstances, a binding arbitration option may be available before a Privacy Shield Panel.
We retain Personal Information for as long as necessary to provide the services and fulfill the transactions you have requested, or for other essential purposes such as complying with applicable laws, legal process and our legal obligations, resolving disputes, enforcing our agreements and protecting and defending our rights and property.
